Left wing Democrats from New York Times columnist Maureen Dowd to former President Jimmy Carter are chiming in to proclaim that critics of President Obama's policies are racists. Those making such unsubstantiated claims are revealing that they have no substantive response to the arguments of the critics and so are just resorting to name-calling.
President Obama's left wing allies have become increasingly hysterical after the president's nationally televised address last Wednesday to a Joint Session of Congress failed to ignite increased public support for his proposed government takeover of health care. The most recent polls show still increasing majorities opposing the president's plan.
In my American Spectator column yesterday at I explain how the president's address last Wednesday was filled with numerous misleading falsehoods. Over the past couple of days The Wall Street Journal and others have documented further false and misleading statements in that speech. But instead of responding substantively to these criticisms, President Obama's allies have resorted to slandering all the critics as racists. The deceptive campaign for the health overhaul and the non-substantive name-calling response to critics is only further alienating public majorities, as the polls show.
We see the exact same problem on other issues, such as global warming and proposed cap-and- trade legislation to counter it. The advocates of man-caused global warming and cap-and-trade have already admitted that they canât defend their positions in debate. But they continue to advocate their positions with name calling and sneering at opponents.
At the same time, we see evidence of inappropriate racial considerations in the policies of the Obama administration. Career prosecutors at the Justice Department brought charges against a unit of the Black Panthers after they engaged in egregious voter intimidation tactics during the 2008 elections -- displaying weapons and insulting white voters. But even after these prosecutors had won in court, the Obama Justice Department dropped all charges.
Similarly, after a crowd of black students severely beat a white student on a school bus in Belleville, Mo. a couple of days ago, the Obama Justice Department has shown no interest in opening an investigation. As The National Review commented yesterday:
"If the races were reversed, there is no doubt that the Civil Rights Division under Acting Assistant Attorney General Loretta King would already have issued a press release about its intent to probe the beating and pursue a possible hate-crimes prosecution under 18 U.S.C. §245."

Tony Mauro, a writer for the First Amendment Center wrote an article about the upcoming Supreme Court Case, Citizens United v. Federal Elections Commission. The case deals with whether Citizens United documentary, "Hillary: The Movie" was an "electioneering communication" under McCain-Feingold and therefore, subject to regulation by the FEC.
The ACRU filed an amicus brief in support of Citizens United arguing that it is a movie, and not subject to the regulations of the FEC
ACRU General Counsel Peter Ferrara wrote in the brief and was quoted by the First Amendment Center,
The conservative American Civil Rights Union also made the point in a brief filed in support of Citizens United. "The movie is the cinematic equivalent of an opinion commentary in a newspaper or magazine, or a book presenting political opinions," wrote its counsel, Peter Ferrera [sic]. "As such, it is core political speech entitled to the full protection of the First Amendment. It cannot be prohibited during any election period, or at any other time. Nor can its promotion be excessively burdened by regulatory requirements."
Lee Ellis, a former Vice President at CBS and Gannett wrote on FamilySecurityMatters.org on November 10, 2008 about the problems with resurrecting the Fairness Doctrine.
Said Ellis:
Radio had almost died, but then discovered âformat radioâ that appealed to what was called niche or specialty groups. It started with âTop Fortyâ popular record hits that became highly successful. This was followed by 24-hour news radio stations as was pioneered by two LA radio companies â KNX and KFWB.
Finally, talk radio was started with people like the late Joe Pyne. His daily taped, syndicated radio program was heard in 254 markets and Pyne was also the number-one morning guy in LA in 1966. He was so popular he was allowed to broadcast the 6-10 AM program from his home. He also was the first outraged, outspoken voice on national television, the father of modern conservative talk shows, blazing a path for Morton Downey, Jr., Wally George, Bill O'Reilly, Rush Limbaugh, Laura Ingraham, Sean Hannity, and many others. Radio really grew and began to dominate the marketplace in the daytime. Today there are 31 AM plus 49 FM â a total of 80 radio stations â in just the city of Los Angeles, all with their own specialty niche audience groups.

On August 18th, the California Supreme Court ruled on Benitez v. North Coast. This case tests the Freedom of Religion Clause of the California Constitution on the issue of whether a physician has a constitutional right to refuse on religious grounds to perform a medical procedure for a patient because of the patient's sexual orientation.
The American Civil Rights Union filed an amicus brief supporting North Coast Women's Care Medical Group.
Unfortunately, the California Supreme Court ruled in favor of Benitez, with Justice Joyce Kennard writing,
"A religious objector has no federal constitutional right to an exemption from a neutral and valid law of general applicability on the ground that compliance with that law is contrary to the objector's religious beliefs" (italics in the original).
The American Civil Right Union was mentioned in several articles, including the Los Angeles Times, World Net Daily, and The Med Guru.

On May 27th, the California Supreme Court heard a case which could have a drastic effect on religious freedom in that state.
From the San Diego Union Tribune:
The issue is whether fertility physicians at North Coast Women's Care in Vista discriminated against a lesbian couple from Oceanside when they cited religious beliefs in refusing to perform artificial insemination.......That group says this is a "potentially landmark, historic case" that will decide the scope of religious freedom in the state constitution.
The ACRU filed an amicus brief on this case, arguing that a doctor has the right to refuse to perform a procedure on someone whose lifestyle goes against their religious beliefs.

In the March 10th Waco Tribune-Herald, Hans Zeiger has an op-ed talking about Texas Governor Rick Perry's book, On My Honor: Why the American Values of the Boy Scouts are Worth Fighting For.
Zeiger discusses the assault that the ACLU and the left have engaged in for years. He also praises Gov. Perry's defense of Scouting.
Says Zeiger,
What Perry calls the "vices of license" are incompatible with "the virtues of liberty." Though the "culture war" is much larger than the Scouting controversies, the attacks on Scouting serve Perry as a potent symbol of what's at stake.

It's been six years since the odious attacks of September 11 and even though there is an understandable amount of complacency settling in, as Margaret Thatcher warned the first President Bush, it's "no time to go wobbly." It is essential that our policy-makers at home drown out the scare tactics of leftist groups like the American Civil Liberties Union (ACLU). We absolutely must do so in order to make sure that we stay ever vigilant and protect our citizens domestically.

ACRU ANNOUNCES KEN BLACKWELL AS SENIOR FELLOW
WASHINGTON - The American Civil Rights Union announces the addition of Kenneth Blackwell as a Senior Fellow.
"I am delighted to be associated with ACRU. It is a civil rights beacon of light in a sea of public policy darkness," commented Blackwell. "It's commitment to individual freedom, regardless of race, gender, or economic station is refreshing. ACRU is a growing force of reason and moral authority in the American conversation on the US Constitution and civil society."
Kenneth Blackwell joins the ACRU as a Senior Fellow and spokesman on a variety of issues including first amendment rights, voting rights and regulations, national security, and Executive Authority. As the former Secretary of State of Ohio, Mr. Blackwell has also held a number of leadership and service positions in the worlds of business, politics, and economics.
"The ACRU is extremely honored to welcome Ken Blackwell as a Senior Fellow," commented ACRU Chairman Susan Carleson. "Ken brings an excellent balance of scholarship and practitioner's experience to our organization. His work as a public official, writer, and teacher in the public policy arena is respected by conservatives and liberals alike. Mr. Blackwell's public service includes terms as an undersecretary at the U.S. Department of Housing and Urban Development, U.S. Ambassador to the United Nations Human Rights Commission and mayor of Cincinnati. In 1994, he became the first African-American elected to a statewide executive office in Ohio when he was elected treasurer of state.
The American Civil Rights Union protects and defends the civil rights granted to all Americans by the Constitution. The ACRU is a non-partisan 501c(3) tax-exempt organization and receives no federal grants or funding.

Says Blackwell of the US Government's apparent desire to split up gun rights:
The problem with splitting a baby in half is that the baby usually dies. If our rights can be regulated to the point that we can't exercise them in our own homes, then they've been regulated out of existence.

When asked about the claim that these laws depress the turnout of the poor, Ferrara responded,
If you don't have a photo i.d., under this law, the state will give you one for free. If you are too poor even to get one of the free photo i.ds, you can be exempted from the law. The only people who are inconvenienced will be those who are trying to commit voter fraud.

New ACRU Senior Fellow Kenneth Blackwell wrote this op-ed in the New York Sun today. This op-ed discusses two important cases be heard by the US Supreme Court on January 9th.
Crawford v. Marion County and Indiana Democratic Party v. Rokita is about Indiana's new voter ID law. The law requires people voting on Election Day to show a government issue ID.
Mr. Blackwell discusses how important this case is. Talking about the views on this issue Blackwell said this:
These views come from two different ways of looking at voting rights. One outlook is that the system should do everything possible to help facilitate voting. This would mean making voting registration and casting votes as easy and fast as we can. The other is that voting is an important civic duty, with the emphasis on personal responsibility to properly register, go to the appointed locations, and fulfill whatever reasonable requirements are necessary to keep fraudulent votes from undermining the process.
