Congressman Frank Wolf (R-VA) pulled out a Sharpie marker and wrote in big block letters at the bottom of a letter: “THIS IS VERY IMPORTANT. THE FBI MUST COMPLY WITH THE LAW.” The letter was address to FBI Director James Comey.
What rule that the FBI violated was Mr. Wolf referring to?
The FBI violated the ban on cooperation with the un-indicted co-conspirator terrorist organization CAIR (Council on American-Islamic Relations). Not only is CAIR an un-indicted co-conspirator terrorist organization, it is a venomous opponent of free speech, driving various radio talk show hosts off the air such as Michael Graham, now in Boston.
CAIR was determined to be related to the web of terrorist financing during the Holy Land Foundation trials in Dallas, a trial which resulted in guilty verdicts. Afterwards, the FBI issued a blanket policy: no cooperation in the field with CAIR.
Political hacks at the Obama Justice Department issued instructions to ignore the policy. In fact, one of the hackiest of hacks at DOJ, Office of Public Affairs director (at the time) Tracy Schmaler headed the unit that was responsible for issuing orders to violate the policy.
You might ask, why are DOJ press flunkies in Washington D.C. issuing directives to FBI field offices about how to deal with a shady Islamic organization such as CAIR? This question lies at the heart of the issue. It demonstrates the politicized lawlessness in the Eric Holder Justice Department.
Partisan political operatives at the Justice Department press shop were undoing FBI policies against interaction with unindicted co-conspirator terrorist organizations. This is how leftists behave when they obtain power. They exploit their offices to their full potential to impose their personal ideological policies onto the ministerial state. Rules or laws are no concern. Implementing their vision is their imperative, no matter the law.
And so the DOJ press shop issued directives to the FBI ordering interaction with CAIR. From the DOJ Inspector General’s report:
Instead, a different headquarters entity, the Office of Public Affairs (OPA), provided policy interpretation and advice to FBI field offices on potential interactions with local CAIR chapters, without consulting [NAME REDACTED, but I suspect a national security component that would have objected to the interaction.]
Schmaler, a shrill leftist and former reporter for the small town newspaper the Rutland Herald, was issuing directives undermining American national security policy. This is how the Obama administration works.
And so the FBI brought in CAIR to teach “diversity training” to FBI officials in places like New Haven, Connecticut in October 2010 and Chicago in December 2010. The rules specifically prohibited CAIR from participating in an “FBI Citizens Academy” community outreach program. Nevertheless, Schmaler’s shop intervened:
Nevertheless, based on guidance it received from OPA, the Philadelphia Field Office allowed a local CAIR official to attend as an invited guest. A few days later, CAIR-Philadelphia posted an article on its website describing its participation in the training program, with a link to the FBI’s website.
How nice. And the DOJ Inspector General report only pertains to five documented instances of CAIR being brought into the DOJ family. Mr. Wolf correctly notes in his letter this probably “only represents a fraction” of everything else going on. Such is the state of the nation. The institutions responsible for enforcing the law must receive black letter lectures from Congress that the FBI must comply with the law.
Will anything happen to the officials who broke the rules? Will the long train of instances where Tracy Schmaler abused her power as a federal employee haunt her?
No, and no.
The only remedy the Constitution provides for the former question is to defund significantly the operations of OPA so that there is no money to pay the salaries of the people responsible. As for Schmaler, she has made a high-paid soft landing at ASGK, David Axeldrod’s shop, with hardly a scratch.
Pay attention. This crowd rewards their lawless fighters, like the Chicago gangsters of old. The response from conservatives and the GOP must be more than shock and outrage at their behavior, or else it will continue.
